    Chemical distributors are subject to an overwhelming number of federal regulations from multiple agencies, including the Environmental Protection Agency (EPA), Occupational Safety and Health Administration (OSHA), Department of Transportation (DOT), Food and Drug Administration (FDA), Department of Homeland Security (DHS), and others. Most of these rules are complex and change frequently. Whether you are new to chemical distribution regulatory compliance or a hardened veteran, keeping up is a challenge. During this session, NACD Regulatory Staff provided an overview of the chemical distribution regulatory landscape, discussed strategies for staying on top of rules and changes, and shared tools and resources for keeping your business compliant.   • Know Your Customer: Chemical Product Stewardship Best Practices and Available Resources
    Kelly Murray, CISA Chemical Security

    Theft is not the only way that nefarious actors obtain chemicals for misuse as weapons or in illegal trade. They can also use seemingly legitimate means, such as by posing as potential customers or attempting a fraudulent purchase. In this session, CISA chemical security experts will provide an overview of the ever-evolving threat landscape and share best practices in product stewardship, including how to build an active, documented know-your-customer program. Participants will also learn about the range of no-cost services and tools CISA provides to help manufacturers, distributors, retailers, and consumers secure dangerous chemicals to collectively reduce the potential for theft, redirection, contamination, or misuse of dangerous chemicals.

  • FSMA Compliance and a Food Safety Deep Dive

    FDA’s Food Safety Modernization has been in place now for several years and all compliance dates for each of the seven major rules have now since passed. Companies selling food ingredients must comply with all of these rules that apply to your company. By now, most NACD members realize that they do have to comply with some of the FSMA rules, if they are selling food ingredients (even if those are not sold for food use). This session reviewed the rules that typically apply to chemical distributors and provide some common sense, easy-to-implement ways to strengthen your company’s food safety plan , so that your are FSMA-compliant and so that you are giving the food safety assurance that your customers require.   • Square Peg/Round Hole – Distribution Warehouses and RCRA Waste Regulations

    When the EPA developed the initial regulations regarding proper management of hazardous waste, they envisioned the “widget” factory. And they created the regulations based on a company generating the same kind of waste day after day after day. What they clearly didn’t consider at the time, was the notion of a chemical distributor. Attendees learned the various ways that a distribution warehouse, terminals or other non-traditional generators could come to be in possession of hazardous waste and how to comply with the multitude of regulations. This session will provide an overview of the Federal Motor Carrier Safety Administration and their safety initiatives.  The discussion will involve FMCSA discussing policy, enforcement and inspections priorities.

  • The Impact of NFPA 400, Hazardous Materials Code, on Operational Roles
    Valerie Ziavras, NFPA

This session will go beyond just covering the requirements contained in NFPA 400, Hazardous Materials Code by delving into how these requirements impact operational roles. We will look at both passive and active fire protection systems as well as the inspection, testing, and maintenance requirements associated with those systems. We will also discuss change management and some of the operational activities that create compliance or safety issues. This session will look at ways you can be prepared for or respond to these types of changes.

  • Where's My Stuff? Supply Chain Management in the Days of a Pandemic 
    Kyle Cattani, Kelley School of Business, Indiana University

    Supply Chains have existed for millennia, but in the last few decades have experienced dramatic transformations. In particular, technologies such as computers and the Internet have allowed real-time visibility and modeling of supply chain flows while multi-modal shipping technologies have facilitated efficient material movement. Supply Chains have evolved to be lean and efficient with high utilizations and low inventories. In the past couple of years, the “leanness” and “high utilization” of supply chains has become problematic: COVID-19 created large distortions in both supply and demand and supply chains have struggled mightily to keep up. In this session, we explored how Supply Chains have struggled over the past couple of years and take a stab at how recovery might look. Download the slides here.

    A fishbowl at each roundtable were filled with challenges, questions, important industry topics, regulatory issues, human resources dilemmas, and more -- Let's go fishing! Participants "reel in" a topic and discussed with the group at their table. Each fishbowl roundtable has a moderator or a facilitator to keep the discussion on track.

Sustainability, ESG, LCA, net-zero, TCFD. These are all concepts that you have been hearing related to business sustainability. But what can a company do to improve the environment? How do you measure sustainability performance? What is the impact of these sustainability practices on performance? This session will introduce the concept of business sustainability and explain its various elements and how sustainability can be integrated into operations and supply chains.
